TERMS AND CONDITIONS – STONED COLLECTIVE

1. THESE TERMS

1.1 What these terms cover.
These are the terms and conditions on which we supply made-to-order worktops and related products to you (“Products”), including (where applicable) templating, delivery, and installation services.

1.2 Why you should read them.
Please read these terms carefully before you place your order. They explain who we are, how we will provide the Products, how you and we may change or end the contract, what to do if there is a problem, and other important information.


2. INFORMATION ABOUT US AND HOW TO CONTACT US

2.1 Who we are.
Stoned Collective is a trading name and registered trademark of Mo’s Designs LTD, a company registered in England and Wales.

Stoned Collective supplies bespoke worktops and surfaces for domestic properties in the UK.

2.2 How to contact us.

2.3 How we may contact you.
If we need to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided in your quotation or order.

2.4 “Writing” includes emails.
When we use the words “writing” or “written” in these terms, this includes emails.


3. OUR CONTRACT WITH YOU

3.1 How we will accept your order.
Our acceptance of your order takes place upon receipt of the £300 template deposit, at which point a contract will come into existence between you and us.

3.2 If we cannot accept your order.
If we are unable to accept your order, we will inform you and will not charge you for the Products you have ordered. This may be because the required materials are unavailable, due to unexpected limits on resources needed to fulfil your order, because we have identified an error in the price or description of the Products, because we cannot meet a delivery deadline you have specified, or for other reasonable reasons.


4. OUR PRODUCTS

4.1 What our Products include.
Our Products include made-to-measure worktops and may include templating, delivery, installation services, and related items such as sinks, taps, sockets, appliances, splashbacks, upstands, wall cladding, and dining tables.

4.2 All worktops are made to your specification.
Your worktop is designed based on your chosen material, edge profile, thickness, cut-outs, and other options, as well as confirmed dimensions.

4.3 Our Products are bespoke and may vary.
Because our Products are made to order and may use natural or engineered materials, images and samples are illustrative only. Colour, tone, pattern, veining, and texture may vary, and minor dimensional tolerances can occur.

4.4 Products may vary from samples.
Natural markings, veining, fissures, and shade variation are inherent characteristics. We cannot guarantee an exact colour match to any sample, display, or online image.

4.5 Delivery and installation as standard.
Our standard order includes templating, delivery, and installation services, included within your quoted price unless we expressly agree otherwise in writing.

4.6 Delivery-only or collection-only (where agreed).
On rare occasions we may agree delivery-only or collection-only. Where this applies, we rely entirely on the measurements, plans, and specifications you provide. You are responsible for suitability and installation. We do not provide refunds, replacements, or remakes based on customer-provided information unless the Product is faulty. Our 25-year material warranty does not apply where the Product is not installed by us or on our behalf. Risk passes to you after collection, or after delivery if delivery-only.

4.7 Accurate measurements and final price confirmation.
Any quotation is based on the information available at the time. You accept that the total price is subject to confirmation following template/site survey and may vary to reflect exact measurements and any agreed changes made during templating.

4.8 Quotations linked to promotions.
Any quotation issued in connection with a promotional offer is valid only until the expiry of that offer, as shown on the quotation document.

4.9 Sourcing and stock.
Global supply chain issues may affect material availability. Where delays occur, we may offer a closest-match alternative or revised timescales. You may also choose to wait for the selected material or choose an alternative, with pricing confirmed on request.


5. MATERIAL – STONED COLLECTIVE QUARTZ

5.1 Colour, tone and pattern.
Quartz typically offers a more consistent appearance than many natural stones, but slabs are manufactured in batches and slight variances in colour, tone, pattern, and particle distribution can occur.

5.2 Samples and displays.
Samples, swatches, and displays are indicative only and are not guaranteed to match the installed Product exactly.

5.3 Veining.
Where veining is present, it may not align seamlessly across separate pieces and will highlight joins. We will use our expertise to achieve the best overall appearance.

5.4 Surface finishes and fabrication finishes.
Quartz colours are supplied in the stated finish (typically polished; some colours may be textured). Fabrication finishes are matched as closely as possible but may appear slightly different from the top surface.

5.5 Material properties.
Quartz is not completely scratch-resistant, stain-resistant, or heat-resistant. Damage caused by scratches, staining, impact, or heat exposure is not considered a manufacturing fault, except where required by law.

5.6 Underside finish.
The underside of quartz is supplied with a smooth factory finish and is not polished to the same standard as the top surface.

5.7 Mirror particles and resin fills.
Some colours include mirror particles or resin fills within industry tolerances. These are not considered faults.

5.8 Overhangs and support.
Large overhangs and waterfall panels may require support and may have a different underside finish. Any requirements will be confirmed during templating.

5.9 Weight and accessibility.
Quartz is heavy. Final piece sizes depend on access and unit support.

5.10 Joins.
Large pieces typically require joins. Where we install, joins are colour-matched, professionally finished, and visible.

5.11 Hob and sink rails.
A minimum material width is required around hob and sink cut-outs to maintain strength.

5.12 Splashback and wall joints.
Splashbacks and wall cladding may require joins for structural and installation reasons.


6. PRICE AND PAYMENT

6.1 Where to find the price for the Products.
The price (including VAT) is shown on your order confirmation or final order documentation.

6.2 What happens if we got the price wrong.
If the correct price is lower, we will charge the lower amount. If higher, we will contact you for instructions before proceeding.

6.3 Deposits and balance payments (worktops).
A £300 deposit is required to secure the template appointment. The remaining balance must be paid before fabrication and installation are booked.

6.4 Externally sourced materials.
Where third-party materials are ordered, full payment may be required once confirmed, as such materials are non-returnable.

6.5 Accessories.
Payment for sinks, taps, hobs, and accessories is required in advance.

6.6 How you can pay.
Payment can be made by bank transfer or card payment via our sales team.

6.7 Late payment.
Late payment may result in suspension of supply until outstanding sums are paid.


7. YOUR RIGHTS TO MAKE CHANGES

Changes may be requested before or during templating. Once the final order is confirmed for manufacture, changes are not possible.


8. OUR RIGHTS TO MAKE CHANGES

We may make minor or necessary changes to reflect template findings, legal requirements, or technical improvements.


9. TEMPLATING

Template appointments, re-template charges, aborted visits, appliance compatibility, and post-template changes are handled in line with reasonable industry practice and will be confirmed in writing.


10. DELIVERY AND INSTALLATION

Delivery and installation dates are estimates. Site readiness and access are the customer’s responsibility. Minor site variations are normal and not defects.


11. IF YOU CHANGE YOUR MIND

11.1 Before template.
Cancellations at least 7 days before templating receive a full refund of the deposit.

11.2 After template.
If cancelled after templating but before manufacturing, the deposit is retained to cover reasonable costs.

11.3 After confirmation.
If cancelled after manufacturing is confirmed, you are responsible for the full contract price, except where cancellation rights apply under applicable consumer law.


12. YOUR RIGHTS IF THERE IS A PROBLEM

If the Product is faulty, you have legal rights to repair, replacement, or refund under UK consumer law.


13. WARRANTIES

13.1 Our warranties.
Worktops installed by us are covered by a 25-year material warranty, and our fabrication/installation services by a 5-year installation warranty, in addition to your statutory rights.

13.2 Remedies.
Where a genuine fault is established, we may repair, replace, re-perform services, or provide an appropriate refund.


14. CARE AND MAINTENANCE

Care guidance is available on our website and must be followed.


15. LIABILITY

We are responsible for foreseeable loss caused by breach of contract or negligence, and do not exclude liability where unlawful.


16. OUR RIGHTS TO END THE CONTRACT

We may end the contract for non-payment or lack of access, with reasonable deductions for costs incurred.


17. PERSONAL INFORMATION

We use personal information to supply Products and process payments, in line with applicable law.


18. OTHER IMPORTANT TERMS

These terms are governed by English law. If any clause is found unlawful, the remaining clauses remain effective.
